La Asociación de Regantes del Río Maule, presentó la acción legal debido que la empresa estaría tomando agua que no le corresponde y afectaría a los regantes de la zona.

La Asociación Canal Maule presentó un recurso de protección ante el Tribunal de Justicia de Talca, para hacer prevalecer el derecho de propiedad de los regantes en el aprovechamiento de agua.
El presidente de la asociación, Andrés Bravo señaló que la Empresa Pehuenche esta tomando agua que no le corresponde, que sería propiedad de los regantes. “Hemos buscado por todos los medios que empresa Pehuenche respete los derechos de los regantes del canal Maule”.
Asimismo, dijo que han recurrido a las autoridades, sector público incluso el Senado, y aún la empresa se resiste ante la situación. “Hoy tenemos la esperanza que los tribunales van a poner orden dentro del Río Maule”.
Los regantes tiene derecho a un caudal importante dentro del Río Maule, que es captado en la bocatoma de Armerillo, para regar mas de cincuenta mil hectáreas en la zonas de San Clemente, Pelarlo, San Rafael y Río Claro. También, Bravo acotó que se debiera tener 54 cm. cúbicos, pero actualmente se tiene 11, 3 cm. cúbicos.
